Anyone who charges you to prepare or lodge your BAS must generally be registered with the Tax Practitioners Board. Checking takes about two minutes on the free TPB Register, yet many owners never do it. This guide shows how to check, what the result means and what to ask before you hand over your Xero login. It also explains how registered BAS agent services differ from bookkeeping alone.

‍

What is a registered BAS agent?

A registered BAS agent is a person or company registered with the Tax Practitioners Board (TPB) to provide BAS services for a fee. BAS services include advice on, and preparation and lodgement of, activity statements, GST, PAYG withholding and instalments, fuel tax credits and some payroll and super obligations dealt with by the ATO.

To register, an individual BAS agent must meet the TPB's education and experience requirements. The TPB's registration page says registration ensures BAS agents have the qualifications and experience required to provide BAS services. Our guide on what a BAS agent is covers the role in more depth.

‍

Who must be registered?

Anyone who provides BAS services to you for a fee or other reward must be registered, unless an exemption applies. The main exemptions are:

  • Your own employee: a bookkeeper employed by your business, preparing your BAS, does not need to be registered
  • Staff of a registered agent: an employee or contractor of a registered tax or BAS agent, working under that agent's supervision and control, does not need their own registration

That second point matters when a firm uses a team. The firm must be registered, and the work must be supervised by a registered agent. Our article on TPB supervision of offshore BAS work explains how this applies to teams based overseas.

Pure data entry, such as coding transactions with no advice about BAS labels, is generally not a BAS service. But most bookkeepers do more than that, so most should be registered or supervised.

‍

How to check the TPB Register

  1. Go to the TPB public register
  2. Search by the person's name, the business name or the registration number
  3. Narrow the search by suburb or practitioner type if you get several results
  4. Open the record and check the details below

The register is free and anyone can use it. It covers registered tax and BAS agents, and includes any sanctions and Code of Professional Conduct breaches that are on the public record.

‍

What to look for on the record

  • Status: registered, suspended or terminated. Only a current registration counts.
  • Type: BAS agent or tax agent. A BAS agent cannot charge to prepare or lodge your income tax return.
  • Name match: the registered name or business name should match the person or company on your invoices and engagement letter
  • Conditions: some registrations carry conditions that limit what the agent can do
  • Sanctions: any sanctions on the public record are listed

If you are dealing with a firm, check the firm's registration, and ask which registered agent supervises the work on your file.

‍

Why it matters

Using an unregistered provider puts your business at risk in three ways.

No standards to hold them to. Registered agents must follow the TPB's Code of Professional Conduct, which covers honesty, competence, confidentiality and conflicts of interest. An unregistered provider owes you none of this under tax law.

No insurance requirement. Registered agents must meet the TPB's professional indemnity insurance requirements. If an unregistered provider makes a costly error, you may have no one to recover from.

Your lodgements are on the line. You are still responsible for what is lodged in your name. Mistakes in GST, PAYG or super reporting fall back on your business.

Charging for BAS or tax agent services while unregistered breaches the Tax Agent Services Act, and the TPB can ask the Federal Court to impose civil penalties.

Registration also limits what an agent can do: a BAS agent cannot charge to prepare or lodge income tax returns. In Tax Practitioners Board v Lamede Group [2016] FCA 63, a Brisbane registered BAS agent and her company were ordered to pay a combined $81,500 in penalties. She was registered as a BAS agent, but neither she nor the company was registered as a tax agent, and they prepared and lodged income tax returns and advertised tax agent services.

‍

Questions to ask before you sign

  1. What is your TPB registration number, and is it in your name or your firm's?
  2. Who is the registered agent supervising my file?
  3. Where is my data stored, and who can access it?
  4. What professional indemnity insurance do you hold?
  5. What happens to my file if you stop providing the service?

If any of these get a vague answer, keep looking. Our BAS compliance checklist is a useful next step once you have a provider.

FAQ

How do I check if my bookkeeper is a registered BAS agent?

Search their name, business name or registration number on the TPB public register at tpb.gov.au. The record shows whether the registration is current and whether any sanctions apply.

Does my bookkeeper need to be registered?

If they provide BAS services to your business for a fee, yes, unless they are your employee or work under the supervision of a registered agent.

Can a BAS agent do my tax return?

No. A registered BAS agent cannot charge to prepare or lodge an income tax return. That needs a registered tax agent.

What is the difference between a bookkeeper and a BAS agent?

Bookkeeper describes the work, such as reconciling accounts and processing bills. BAS agent is a legal registration that allows someone to provide BAS services for a fee.

What does the TPB Register show?

It shows registered tax and BAS agents, their registration details and status, and any sanctions or Code breaches on the public record.

What if my bookkeeper is not on the register?

Ask whether they work under a registered agent's supervision. If not, and they lodge or advise on your BAS for a fee, consider moving to a registered provider.

Is an offshore bookkeeping team allowed to prepare my BAS?

Yes, if the work is done under the supervision and control of a registered agent, who remains responsible for it.
